Refresh Catering Emporium

Christmas T&C's

A booking deposit is required to secure your party date & time.
For payment by cheque please enclose the name of the organiser & or company name & date of function with your card number & expiry date/issue number on the reverse.
The balance/full amount of the booking must be paid at least 21 days prior to the event or the booking will be deemed cancelled and the date released. 
Any bookings made after December 1st require payment in full upon booking.
All deposits are non-refundable
Additional guests may be added to your party order up to 24/48hrs(subject to availability)
of the event and are payable in full.
For Seated Dinners & Other Staffed/Serviced Events additional guests attending & services required on the day/night will be charged extra at the same rate per person & are payable in full on the night.
All set up/staffing/hire/washing up services are extra; please enquire at the time of booking.
*A returnable Breakages Deposit for presentation service equipment & hire items is required and is based on the size & type of your party or event requirements and must be paid in full at the time the balance/payment in full is due/made. Any additions to food & services required on the day are payable in full. 
*Your summary invoice confirmation is forwarded upon receipt of the required booking deposit.

All dates & offers are subject to availability.  Offers/Discounts may not be used in conjunction with any other offers

These Terms and Conditions, Booking Information/Policy and our Privacy Policy govern your use of the refreshce.co.uk website and your relationship with refreshce.co.uk
Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, Booking Information and our Privacy Policy, please do not use the refreshce.co.uk site. 
The refreshce.co.uk site is provided to you free of charge for your personal use subject to all Terms and Conditions.  By using our site you agree to be bound by these Terms and Conditions.
Refresh Catering Emporium and its agents provide their services of this website to you subject to this Terms & Condition of use. Your access and use of this website is pre-conditioned on you accepting the following notices, booking information, disclaimers, consents, terms and conditions. (The term 'agents' refers to Refresh’s web host and web payment processors).


Booking Information/policy, Payment & Delivery:
You must ensure that the details provided by you on ordering or at any time are correct and complete. You must inform us immediately of any changes to the information that you provided when ordering by updating your details by contacting us at sales@refreshce.co.uk. Refreshce.co.uk may suspend or cancel your order immediately at our reasonable discretion or if you breach the terms & conditions, booking & privacy policy.When confirmation of order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your, and hence a contract between us, when we send you an invoice or order confirmation receipt where as invoice is to follow . We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason.In the case of a change of price, we will always contact you first to ensure that the price is acceptable.                                                                                                                                                                                                       
The company’s(Refresh) written quotation, which the client/customer/buyer/hirer shall accept in writing by signing the summary above to be returned prior to the event with the required deposit.  The absence of such written quotation or acceptance however shall not invalidate the Contract and all catering/event work quoted for and undertaken by or goods hired from the Company shall be subject to these terms and conditions and the client/customer/buyer/hirer by authorizing or allowing work to proceed or goods to be delivered is deemed to have confirmed the Contract and to have accepted these terms and conditions.  Late payments made after the due date will be subject to interest charges at the rate of 5% per month unless prior arrangements have been made for later payments under our corporate contract/agreement (This may only be set up in advance of any booking/service provided).


A booking or order deposit is required for reserving a time/date for all catering orders, party dates requiring staff & time, all orders, cakes, gift baskets etc. 
All Booking & Order Deposits are non-refundable but may be transferable subject to date availability/depending on the circumstances and purely at our discretion.
 

A planning/designing deposit is required for all major events, weddings, bespoke orders and corporate promotions once a booking deposit has been made to cover initial services including multiple site visits and services etc. catered for prior to any installments/final payments made and is non refundable.  Multiple changes to outside catering event menus and orders are charged accordingly.
The balance/full amount of the booking must be paid in full prior to any event unless arrangements have been made for payment on delivery or corporate CCPA's apply.  Additional guests may be added to your party up to 24/48hrs(subject to availability during peak seasons)(Last minute bookings under 14 days requiring finalised guests numbers exceeding more than 10 made after ordering cut off dates are required to pay the full deposit amount due for approximate guest numbers to cover costs which are non-refundable.  Seated Dinners & Other Staffed Events where additional guests attend & further services are required on the day/night will be charged accordingly at the same rate per person & are payable in full on the day/night.  Any additions to food & services required on the day are payable in full.  Late bookings/orders under 14 days of event and those requiring additional bespoke services/staffing/equipment are subject to any applicable late service charges/last minute /fast turnaround planning fees and are payable in full upon booking.

All discounts/offers offered/sent with booking quotes are based on the order numbers & total order cost enclosed are subject to alteration for any further or amended quotations and may not be transferable to a lesser booking.
All catering services are subject to vat.

A Breakages deposit is required for all bookings requiring presentation service ware equipment/crockery hire etc.
*All equipment, crockery, silverware, linen and bespoke item hire including disposables are charged separately and are subject to vat and all items must be returned clean.  Broken/damaged/unreturned items may not be substituted with alternative replacements and will be charged per item.  (Any specialist or bespoke items if broken or damaged must still be returned) If you require a washing up service please ask at the time of booking or final confirmation, otherwise items returned unwashed will be charged and deducted from the Breakages deposit/or if where any losses/damages/cleaning service etc. exceed the value of the breakages deposit already paid an additional cost for items & cleaning services will be due and payable in full.

*Breakages & any other deposits will be held until payments have been cleared and returns have been processed over a 14 day working period (with exception of bank holidays etc. which may be longer due to banking limitations) which maybe up to a 21 day period depending on busy periods, opening times and which processing cycle the event falls in. 
For Christmas/New Year deposit and collection cycle information periods please enquire as we are closed for one week. 

Deposit Cheques/card payments for all presentation & equipment hire will be deposited/collected & a cheque/refund will be issued upon receipt of all working equipment(less any breakages/damage/losses if any & less any applicable card services charges at the corresponding rates).  Functions with service platters etc. & equipment hire will be collected by Refresh/or returned by client within approximately 2-3 working days(as per summary arrangement details) with the exception of event collection falling on certain days or during busy periods which may be up to or beyond 7  working days as we are closed on Sundays(with the exception of booked events).  Sunday collections if required are by arrangement only and are charged at an hourly rate of £15.00 depending on distance and must be arranged with the Catering Manager in advance of delivery.
**Please note All equipment, crockery, platters, baskets & equipment must be returned clean (unless you have arranged for the cleaning hire service otherwise a charge of 20% of the cost will be added and payable or deducted from the breakages deposit) & in good repair.  Electrical equipment will be tested upon receipt and held/deposited cheques will be returned/issued (less any deductions if any) within the processing cycle as above.  Equipment, crockery, silverware etc. may not be replaced with alternative items if broken/damaged/missing due to sets/designs/measurements/guarantees etc. 

Late bookings made within 48hrs of the event/delivery may be subject to a last minute booking fee depending on the type/size of event.  Bookings made for late night events falling between the hours of 11pm-7am and bank holidays are subject to an out of hours service fee depending on the type/size of event or booking.  Any changes to standard orders may only be made up to 24hrs of delivery if authorised by the catering manager and are subject to availability.

All TEN licensing activity and administration costs are non-refundable. 
A Corkage charge is applicable for or all events requiring beverage services where the client has provided any of their own supplies.

All set up/staffing/hire/washing up services are extra please enquire at the time of booking:
Staff - Chef/Hostess/Bar/Waiting/Custodial are all charged by the hour or by event package depending on the requirements(at a min of 2hrs local/min 3hrs surrounding area during standard hours & after 8pm min 4 hrs/for late hours 10pm onwards or for large events, long distance or multiple events please enquire) & are subject to vat. 

Further order specific T&C are available on request/forwarded with your summary invoice after the booking deposit has been made or with your order confirmation receipt.

*All products are subject to availability & seasonal price change without prior notice.

Payment &Refunds:

We accept payment by cash, cheque or debit or credit card/PayPal (you do not need a PayPal account to use this service) All payments made by card services/PayPal or cheque must be cleared before we can start making your order.  *Payments under £20.00 will be subject o a 70p handling fee/Debit Credit Card Services are subject to 50p cost/non business cards 2%/commercial cards 2.5%/American Express non-commercial/commercial/Debit 3.25/3.25/70p/Paypal 3.5% where applicable.
All orders require a minimum 50% deposit at the time of ordering/payment in full on all last minute orders and those under 14days, unless a corporate account is in place.
All traditional fruit cakes for celebrations & weddings require a 50% deposit and must be paid for in full by the due date before the order is begun/approximately 3 months prior to the event date.
Please ensure that the expiry date of your credit/debit card is after the final due payment of your order.  Payment is taken at the point of ordering in full or as a series of deposits and in the event that the payment card has expired we will be unable to complete your order unless you provide us with an alternative method of payment made prior to any collection or delivery.  Any deposits made up to that point will be non-refundable as per the summary requirements details with your order confirmation.  
Protecting your order information is a priority for us. We use Paypal for the online ordering payments. Paypal use state of the art data encryption anti-fraud risk models and address verification system, a card security code and a team of verification & anti fraud specialists sophisticated technology to protect the security of your payment information.
To use the refreshce.co.uk for purchasing any products – baskets/hampers/items/products containing alcohol you must be over eighteen years of age.  Proof of age may be required upon collection or delivery.
No refund, exchange only on emporium products.
All food & services are non-refundable.
All Booking & Order Deposits are non-refundable but may be transferable subject to date availability/depending on the circumstances and purely at our discretion.
If you fail to collect any order or accept any delivery, monies will not be refunded and you shall still be charged in full if on account.  All Food & Perishable products are sold as seen whether purchased and collected in store or delivered to your chosen address.  We are not responsible for any holding temperatures or safe storage of food after collection or delivery.  Neither Refresh Catering Emporium nor Harper & Wilson Limited accept liability or responsibility for the condition and safety of any food taken off the premises or remaining from a function or after its removal from the function to any other location.  Full responsibility for ensuring food is kept protected from contamination and at safe temperatures after collection or delivery rests with you the client/customer.   Nor do we accept liability or responsibility for the condition and safety of any other food/s or products prepared or supplied by the customer or customers other caterers or suppliers brought onto the same function premises or after its removal.

Force Majeure:
If Refresh is restricted hindered delayed or prevented from carrying out its obligations hereunder by any circumstances beyond their control then Refresh shall not be liable to the client/customer/buyer for any loss or damage whether direct or indirect which may thereby be suffered by the client/customer/buyer. Furthermore Refresh shall be at liberty to terminate or suspend any contract governed by these conditions without bearing any liability for damage resulting to the client/customer/buyer. *Marquees & Events Additional Booking Information & Terms will be provided separately at the time of ordering.
All offers are subject to availability, seasonal changes and while stocks last. Where any online and shop offers states that a percentage discount will be given on a purchase, the cost of the qualifying purchases will be reduced by the stated discount percentage.  Supplementary charges such as delivery or postage & packing etc. shall not be discounted unless specifically stated in the offer description.

Delivery:
We deliver throughout Greater Manchester and further a field – please ask at the time of enquiry (mileage/delivery charges will apply depending on the order.)  Postal deliveries are currently limited to Emporium fabric products only.
Take Away Sandwich Shop Orders: Free local deliveries in the village & surrounding area.  Minimum order delivery £10.00 for vehicle deliveries. Outside 2 mile radius minimum order value £15 (or delivery charges apply depending on distance) *If you are placing multiple orders for delivery to a business group/tower block please check in store for ordering and delivery times/slots where applicable.  Please note our delivery persons only carry a small amount of exact change for your order.  *All orders must be paid for at the main door or ground floor reception only.
Catering/Cake/Emporium/Web Orders: Free local deliveries in the village & surrounding area.  Outside 3 mile radius minimum order values may apply, please ask at the time of enquiry. *All orders and breakages deposits must be paid for in advance of delivery unless an account is set up or you have made special arrangements approved by us prior to delivery.  *Full delivery timings & other related details subject to your specifications and our scheduling for individual orders & events will be forwarded upon confirmation of your order.
It is your responsibility to make sure that someone is there to accept the order upon delivery (no refunds are given if there isn’t anyone home but we will endeavor to leave it with a neighbour, at a reception desk or with a colleague or you can come & collect it within our opening hours) (If you are unable to accept the delivery and it comes back to the shop for your collection we are not responsible for its (any food or perishable item) condition after the day of delivery/collection) If you fail to accept any delivery, monies will not be refunded and you shall still be charged in full if on account.   
Each order, collection or delivery shall constitute a separate order contract and any failure or defect in any one delivery shall not affect the contract as to the remaining deliveries.
We reserve the right to refuse delivery.  We cannot sell or deliver alcohol to persons under the age of 18 (Proof of age may be requested)

All Food & Perishable products are sold as seen whether purchased and collected in store or delivered to your chosen address.  We are not responsible for any holding temperatures or safe storage of food after collection or delivery.  Neither Refresh Catering Emporium nor Harper & Wilson Limited accept liability or responsibility for the condition and safety of any food remaining from the function or after its removal from the function to any other location.  Full responsibility for ensuring food is kept protected from contamination and at safe temperatures after collection or delivery rests with you the client/customer.   Nor do we accept liability or responsibility for the condition and safety of any other food/s or products prepared or supplied by the customer or customers other caterers or suppliers brought onto the same function premises or after its removal.
The liability of Refresh under the contract shall in no circumstances exceed the purchase price of the goods in question. Refresh shall not be liable for any loss or damage howsoever caused whether consequential or otherwise.  Notice of any claim arising out of or in connection with any contract must be given in writing to Refresh within 7 working days from the date when the goods are collected or delivered, failing which all claims shall be deemed to be waived and absolutely barred.  Refresh shall be under no liability for shortage or damage in transit or for deviation mis-delivery or detention.
